By accessing or using the Service you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms and conditions then you do not have permission to access the Service.
If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
If you are considering a mix of common birds and ‘Pre-Order’ birds within your order, please submit two separate orders, so that we can ship your common birds right away. ‘Pre-Order’ birds can then be shipped upon arrival. Putting both bird types in your order can cause substantial delays in shipping.
All orders are shipped on a first come, first served basis.
In addition, delays in shipping may occur as a statement of unforeseen weather events, bacteria or virus conditions, and or additional conditions that may interrupt the normal process of quality control and or shipping. The Finch Farm Co. will make best efforts to deliver your order as soon as time and conditions permit. However, unexpected delays may occur, and during such events, refunds are not applicable. The nature of live companion pets and the complexity of their product types warrant patience and understanding. The Finch Farm Co. will endeavor to communicate during any such events.
Availability, Errors and Inaccuracies
We are constantly updating product and service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other web sites. The information found on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable on the Service and we cannot guarantee the accuracy or completeness of any information found on the Service.
We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Live Arrival Guarantee
We take great pride in shipping healthy and active birds to our customers. If a bird has perished upon arrival, you will be provided a Finch Farm Credit for the amount paid on the perished bird. The credit (coupon code) can be used for a future purchase of anything on our webstore. If you choose to replace a perished bird any shipping costs, including travel boxes necessary to ship live birds, are solely the responsibility of the customer.
* Please note on occassion a necropsy by a Board Certified Avian Veterinarian may be requested to determine cause of death prior to issuing any credit for perished birds under both the live arrival guarantee and extended warranties. Once you receive the necropsy results, they must be sent to us at CustomerSupport@TheFinchFarm.com within 24hrs of completion. (If a necropsy is requested and you are unable to find a Certified Avian Veterinarian, we will have one done for you.) You will need to notify us immediately at CustomerSupport@TheFinchFarm.com so that we can provide you with instructions on how best to preserve your bird and how to ship it back to us.
While antibiotics may occasionally need to be used to treat birds, we recommend that usage is coordinated with your Veterinarian. If any of the birds are 'tucking' their head, sleeping all day, fluffed up and/or lethargic, using anti-biotics as their only water source may be considered, however, good Veterinarian guidance is always recommended.
If you have any issues or concerns about your birds, please notify us within 3 hours of receipt of your order. Once birds are under the care of the customer, it is our customer’s responsibility to make sure that the bird(s) have everything they need to thrive in their new environment. Researching your birds before purchasing is always recommended.
Preventative pet bird care products are offered on our website to help keep your birds healthy and vital.
Be sure to review our Bird Care Instructions to ensure proper bird care that is essential to our Live Arrival Guarantee.
We can only HONOR CLAIMS within 24 HOURS of receiving your bird(s).
Cancellation and Refund Policy
Due to the complexity of our supply chain management and inventory systems, live animal orders are unavailable for cancellation or refunds. When your order is placed, your items are automatically added to these systems. Interrupting this structure is quite costly in terms of human resource and overstock, which potentiality results in increased prices. Live animal orders are final and unavailable for cancellation, refunds or returns.
If a live animal order order must be cancelled, a Finch Farm Credit will be provided in the form of a Coupon Code for the amount of the order and any shipping paid. No refunds will be given.
Cancellation and Refund Policy Regarding Non-Live Products
Customers are responsible for paying any shipping costs associated with any returns. Customers can exchange non-live products for a new item or return the product for a full refund or credit. Customers are required to contact us prior to returning any products. It is the Customer's Responsibility to pay any restocking fees associated with any returns of merchandise. All non-live products returned are subject to a 20% restocking fee. Sale items are not eligible for refunds or credit.
Any fees assessed for non-pickup of live animals will the be sole responsibility of the customer.
Contests, Sweepstakes and Promotions
When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
The Service and its original content, features and functionality are and will remain the exclusive property of The Finch Farm Co., dba The Finch Farm .Com, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
